Text Box: The following quick reference chart lists the current minimum wage rates for all states, the District of Columbia, and Puerto Rico. State minimum wages below the federal minimum wage of $5.85 till 7/23/08 and $6.55 from 7/24/08 to 724/09 apply only to employees not covered by the Fair Labor Standards Act (FLSA). In addition, the chart lists the tip credit percentages employers may apply toward the minimum wage, plus the computed actual tip credit amount and the resulting minimum cash wage for tipped employees based on the state minimum wage. (Federal Minimum Wage rises to $7.25 on 7/24/09)

Employers subject to the federal minimum wage must apply the state tip credit percentage to the federal minimum wage to calculate the actual tip credit amount and the resulting minimum cash wage required under state law. Where the state tip credit differs from the federal, the employer must separately calculate the tip credit and minimum cash wage under both federal and state law and follow the law yielding the higher cash wage.
